The following are our terms and conditions for use of the website.
1.GemologyAfrica is a business in the general trade industry that sells coloured gemstones and mineral specimens in various forms primarily to the jewellery trade, gemstone suppliers, and private collector market. .
2.Our Delivery Policy is that the items purchased are subject to availability and receipt of payment. Requests will be processed within 5 working days and delivery confirmed by way of a purchase order. For deliveries within South Africa, Postnet Services or DHL courier services will be used. For international deliveries, DHL or Aramex courier services will be used. The cost of delivery will be for the buyers account.
3. Export restriction. The offering on this website is available to all countries where DHL/Aramex provides courier services to.
4. Return and Refunds policy The provision of goods and services by GemologyAfrica is subject to availability. In cases of unavailability, GemologyAfrica will refund the client in full within 30 days. Cancellation of orders by the client will attract a 10 % administration fee. (The package will be adequately packed to ensure safe delivery. However, if the item is damaged on receipt, this must be communicated in writing to GemologyAfrica and returned for inspection. Thereafter, if appropriate – a refund will be effected. GemologyAfrica takes care to accurately describe the item for sale but offers no guarantee or warranties on the item
5. GemologyAfrica shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from: http://www.polity.org.za/attachment.php?aa_id=3569. In terms of POPIA Act which comes into effect on 1st July 2021, GemologyAfrica advises that it does collect personal information from buyers, being their name, contact and address details for purpose of processing the order and delivering the product and takes all reasonable steps to protect this information, undertakes to use it only for the sole purpose for processes the order, and undertakes not to share this information with any other vendor. By processing an order, you give consent to providing GemologyAfrica with this information and permission to use it for the purpose of processing the order.
6. Payment may be made via Visa or MasterCard, by bank transfer/wire or through Paypal services.
7. Card acquiring and security Card transactions will be acquired for GemologyAfrica via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
8. Customer details separate from card details Customer details will be stored by GemologyAfrica separately from card details which are entered by the client on DPO PayGate’s secure site. For more detail on DPO PayGate refer to www.paygate.co.za.
9. The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is United States Dollars (USD).
10. GemologyAfrica takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
11. This website is governed by the laws of South Africa and GemologyAfrica chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 36 Ridge Drive, Whale Rock Ridge Estate, Robberg Road, Plettenberg Bay, 6600. .
12. GemologyAfrica may, in its sole discretion, change this agreement or any part thereof at any time without notice.
13. This website is run by BravoPro 574cc based in South Africa trading as GemologyAfrica and with registration number 2011/095625/23 and Directors being Leonard Wilfred Freeman and Mandy Jane Freeman.
